1. Company Information: Trekbooker Is a Software Platform

Trekbooker ("Trekbooker", "we", "us", "our") provides software tools that allow independent tour operators, guides, outfitters, instructors, adventure businesses, and other activity providers ("Operators") to manage bookings, collect payments, communicate with customers, and operate their businesses.

By using Trekbooker, you acknowledge and agree that:

  • Trekbooker is a software platform.
  • Trekbooker is not a travel agency.
  • Trekbooker is not a tour operator.
  • Trekbooker is not an outfitter.
  • Trekbooker is not a guide service.
  • Trekbooker is not a transportation provider.
  • Trekbooker does not supervise activities.
  • Trekbooker does not inspect guides.
  • Trekbooker does not inspect equipment.
  • Trekbooker does not inspect vehicles, vessels, aircraft, or facilities.
  • Trekbooker does not verify licenses, permits, certifications, or insurance.
  • Trekbooker does not guarantee safety.

All tours, experiences, activities, rentals, excursions, transportation services, and related services are offered and provided solely by independent Operators.

Trekbooker is not a party to any agreement between an Operator and a Guest.

2. Independent Operators

Operators are independent businesses.

Operators are not employees, agents, representatives, partners, joint venturers, contractors, or affiliates of Trekbooker.

Nothing in these Terms creates any employment, agency, partnership, or joint venture relationship.

Operators are solely responsible for:

  • Conducting activities
  • Hiring personnel
  • Maintaining equipment
  • Safety procedures
  • Emergency planning
  • Compliance with laws
  • Licenses and permits
  • Insurance coverage
  • Customer interactions
  • Service delivery

3. User Accounts

You agree to:

  • Provide accurate information
  • Maintain account security
  • Keep login credentials confidential
  • Accept responsibility for activities occurring under your account

4. Payments and Stripe Connect

Payments are processed through Stripe Connect.

Operators are the merchant of record for all bookings processed through the Platform.

Trekbooker:

  • Does not hold customer funds
  • Does not act as a bank
  • Does not act as a money transmitter
  • Does not provide financial services

You agree to comply with all applicable Stripe terms and requirements.

5. Risks of Activities

Outdoor and adventure activities involve inherent risks.

Risks may include:

  • Falls
  • Drowning
  • Vehicle accidents
  • Aircraft incidents
  • Wildlife encounters
  • Environmental hazards
  • Equipment failures
  • Illness
  • Serious bodily injury
  • Death

Guests voluntarily assume all risks associated with activities booked through the Platform.

6. No Safety Guarantee

Trekbooker makes no representation or warranty regarding:

  • Safety
  • Quality
  • Legality
  • Operator qualifications
  • Equipment condition
  • Insurance coverage
  • Regulatory compliance
  • Fitness for purpose

Participation in any activity is at the sole risk of the Guest.

7. No Endorsement

The presence of an Operator, activity listing, review, badge, ranking, photograph, advertisement, recommendation, or search result on the Platform does not constitute an endorsement, certification, guarantee, or verification by Trekbooker.

8. Limitation of Liability

To the maximum extent permitted by law:

Trekbooker shall not be liable for:

  • Personal injury
  • Wrongful death
  • Property damage
  • Lost profits
  • Lost revenue
  • Lost data
  • Business interruption
  • Incidental damages
  • Indirect damages
  • Special damages
  • Consequential damages

Trekbooker's total liability shall not exceed the greater of:

  • $100 USD; or
  • The amount paid to Trekbooker during the previous twelve (12) months.

9. Indemnification

You agree to defend, indemnify, and hold harmless Trekbooker and its owners, officers, employees, contractors, and affiliates from any claims, damages, liabilities, losses, costs, or expenses arising out of:

  • Your use of the Platform
  • Operator services
  • Injuries or deaths
  • Violations of law
  • Refund disputes
  • Chargebacks
  • Taxes
  • Intellectual property claims

10. Prohibited Conduct

You may not:

  • Violate laws or regulations
  • Commit fraud
  • Misrepresent services
  • Upload harmful software
  • Attempt unauthorized access
  • Interfere with platform operations

11. Termination

Trekbooker may suspend or terminate any account at any time and for any reason.

12. Arbitration

Any dispute relating to these Terms shall be resolved through binding arbitration in Washington State.

You waive participation in class actions and jury trials to the fullest extent permitted by law.

13. Governing Law

These Terms are governed by the laws of the State of Washington.

14. Changes to Terms

We may update these Terms at any time.

Continued use of the Platform constitutes acceptance of revised Terms.
